Please read these Terms of Service carefully before using our credit repair or funding services. By engaging with us, you agree to be bound by these terms.

Above N Beyond & Associates
These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("Client," "you," "your") and Above N Beyond & Associates ("Company," "we," "us," "our"). By accessing our website, booking a consultation, signing a service agreement, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
Section 01
Acceptance of Terms

By engaging with Above N Beyond & Associates in any of the following ways, you confirm your acceptance of these Terms:

Visiting or using our website at abovendbeyond.com or any associated landing pages
Submitting a contact form, funding survey, or booking request
Signing or electronically accepting a Client Service Agreement
Making any payment for our services
Authorizing us to access, review, or dispute your credit reports
Participating in a free consultation call or paid coaching session
These Terms should be read in conjunction with our Privacy Policy, which is incorporated herein by reference and governs how we collect, use, and protect your personal information.
Section 02
Description of Services

Above N Beyond & Associates provides the following services to individual consumers and business owners. Specific services will be detailed in your individual Client Service Agreement:

Credit Repair Services
Review and analysis of consumer credit reports from Experian, Equifax, and TransUnion
Preparation and submission of dispute letters to credit bureaus and original creditors
Follow-up on bureau responses and escalation of unresolved disputes
Monthly credit progress monitoring and reporting
Creditor negotiations and goodwill deletion requests
Credit score improvement strategies and tradeline guidance
Business Funding Services
Business credit profile assessment and lender eligibility evaluation
Matching clients with appropriate lenders from our network
Assistance with funding application preparation and documentation
Business credit building and establishment services
Guidance on SBA loans, business lines of credit, and equipment financing
Financial Coaching Services
One-on-one financial coaching sessions
Credit education and management training
Budgeting and debt reduction planning
Wealth-building strategy consultations
We are not a law firm and do not provide legal advice. We are not a licensed financial advisor, mortgage broker, or bank. Our services are limited to credit repair, financial coaching, and funding referral/placement as described above. For legal advice, consult a licensed attorney.
Section 03
CROA Disclosures & Your Rights
Required Federal Disclosure Under CROA: You have a right to dispute inaccurate information in your credit report without the help of a credit repair organization. You may contact the credit bureaus directly at no charge. The use of a credit repair service is entirely optional and voluntary.
Your Rights as a Consumer
Free Credit Report
You have the right to a free copy of your credit report from each bureau once every 12 months at annualcreditreport.com
Free Direct Disputes
You have the right to dispute inaccurate information directly with the credit bureaus free of charge
3-Day Cancellation Right
You have the right to cancel any contract with a credit repair organization within 3 business days of signing
Right to Sue
You have the right to sue a credit repair organization that violates the CROA in federal or state court
Right to File Complaints
You have the right to file a complaint with the FTC at ftc.gov or the CFPB at consumerfinance.gov
What We Are Prohibited From Doing
Charging or receiving payment before services are fully performed (in applicable jurisdictions)
Making false or misleading statements about your credit history or our services
Advising you to make false statements to any credit bureau, creditor, or government agency
Advising you to change your SSN or identifying information to obtain a "new" credit identity
Discouraging you from exercising your legal rights
Section 04
Client Responsibilities

To enable us to provide effective services on your behalf, you agree to the following responsibilities and obligations:

Accurate Information
You agree to provide accurate, complete, and truthful information in all communications, forms, and applications. Providing false information is grounds for immediate termination without refund
Timely Cooperation
You agree to respond to our requests for information, documents, or signatures within 5 business days to avoid delays in your service
Responsible Credit Behavior
You understand that new collections, missed payments, or hard inquiries during the repair process can negatively impact your results and agree to follow our credit management guidance
No Parallel Disputes
During active engagement, you agree to direct all credit disputes through us rather than filing separately with bureaus, which can create conflicts in the process
Legal Use Only
You agree to use our services only for lawful purposes and will not attempt to create fraudulent credit profiles or misrepresent your identity
Section 05
Fees, Payments & Billing

All fees are disclosed in your individual Client Service Agreement prior to the commencement of any paid services. The following general billing terms apply to all clients:

Payment Terms
All fees must be paid in U.S. dollars via accepted payment methods at the time of enrollment
Monthly subscription fees are billed automatically on the same date each month. You authorize recurring charges by enrolling in a monthly program
Failed payments may result in a suspension of services until payment is received
All fees are disclosed in your written Service Agreement before any charge is made. We do not charge hidden fees
Section 06
Refund & Cancellation Policy
3-Day Right of Rescission: In compliance with CROA, you have the right to cancel your credit repair service agreement within 3 business days of signing without penalty or obligation. Any payments made within this window will be fully refunded.
Cancellation After 3-Day Period
You may cancel your monthly subscription at any time with at least 5 business days' written notice before your next billing date
Cancellations received after the 5-day window take effect at the end of the next billing cycle
Monthly fees already charged for the current billing period are non-refundable once work has commenced
One-time setup fees and first-month fees are non-refundable after work has begun, except within the 3-day rescission window
Funding Service Fees

Fees associated with our funding placement services are performance-based and charged only upon successful funding. If a funding application is not approved, no placement fee is charged. To cancel services, send a written request to [email protected] with your full name and effective cancellation date. We will confirm cancellation within 2 business days.

Section 07
No Guarantee of Results
Important Disclaimer: No credit repair company — including Above N Beyond & Associates — can legally guarantee specific credit score improvements, specific item removals, or specific funding approval outcomes. The CROA expressly prohibits guarantees of results.

While our team works diligently and has achieved strong results for many clients, individual outcomes vary based on factors including but not limited to:

The nature, age, and accuracy of negative items on your report
Creditor and bureau cooperation and response timelines
Client's ongoing credit behavior during the repair process
Number and complexity of items to be disputed
Lender underwriting standards and eligibility criteria
Changes in applicable laws and bureau policies
Overall economic and market conditions
Historical client data reflects past performance and is not a guarantee of your specific results. Past performance is not indicative of future outcomes.
Section 08
Limitation of Liability

To the maximum extent permitted by applicable law, Above N Beyond & Associates and its officers, directors, employees, agents, and affiliates shall not be liable for:

Indirect or Consequential Damages
Including lost profits, lost business opportunities, lost data, or any other indirect, incidental, or consequential damages arising from use of our services
Bureau or Creditor Actions
We are not liable for actions taken or not taken by credit bureaus, creditors, or collection agencies in response to disputes filed on your behalf
Lender Decisions
We are not liable for any lender's decision to approve or deny a funding application. Lending decisions are at the sole discretion of the lender
Third-Party Services
We are not liable for the actions, content, or services of third-party websites, platforms, or vendors linked to from our website
Force Majeure
We are not liable for delays or failures resulting from circumstances beyond our reasonable control
In no event shall our total cumulative liability to you exceed the total amount of fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.
Section 09
Prohibited Conduct

You agree that you will not use our services, website, or any information provided by us for any of the following prohibited purposes:

Creating a false credit identity or using another person's identifying information
Submitting false or fraudulent information to creditors, lenders, credit bureaus, or government agencies
Using our services to facilitate any form of fraud, identity theft, or financial crime
Violating any applicable federal, state, or local laws
Attempting to gain unauthorized access to our systems, client data, or internal records
Reproducing, distributing, or reselling our proprietary dispute letters, templates, or methods without written consent
Making false or defamatory statements about our company, employees, or services on any public platform
Violation of any of these prohibitions is grounds for immediate termination of all services without refund and may expose you to civil and criminal liability.
Section 10
Intellectual Property

All content, materials, and intellectual property published or made available by Above N Beyond & Associates — including our website design, logo, brand name, written content, dispute letter templates, training materials, and coaching content — are the exclusive property of Above N Beyond & Associates and are protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, copy, distribute, or create derivative works from any of our materials without prior written permission
Our dispute letter templates, scripts, and proprietary methods are confidential and may not be shared, resold, or publicly disclosed
Nothing in these Terms grants you a license to use our intellectual property except as expressly stated in your Service Agreement
Client testimonials shared with us are licensed for marketing use, with your consent, and are subject to removal upon written request
Section 11
Dispute Resolution & Arbitration

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or our services, the parties agree to attempt resolution through the following process:

Direct Resolution
Contact us at [email protected] to describe your concern. We commit to responding within 10 business days with a proposed resolution. We resolve the vast majority of concerns at this stage.

Mediation
If direct resolution is unsuccessful, both parties agree to attempt non-binding mediation through a mutually agreed-upon mediator before proceeding to any formal legal process.

Binding Arbitration
If mediation is unsuccessful, all disputes shall be resolved through final and binding arbitration conducted by a recognized arbitration organization under applicable consumer arbitration rules. You waive your right to a jury trial and to participate in any class action lawsuit by agreeing to these Terms, except where such waiver is prohibited by law.
Exception: Nothing in this section prevents either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm while arbitration proceeds.
Section 12
Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the laws of the State in which Above N Beyond & Associates is registered to conduct business, without regard to conflict of law principles. Where applicable, these Terms are also subject to the following federal laws:

Credit Repair Organizations Act (CROA)
Fair Credit Reporting Act (FCRA)
Gramm-Leach-Bliley Act (GLBA)
FTC Act — Section 5
Electronic Signatures in Global and National Commerce Act (E-SIGN)
Applicable state consumer protection statutes
Section 13
Termination of Services
Termination by You

You may terminate services at any time with written notice as described in Section 06 (Refund & Cancellation Policy). Termination does not waive any amounts owed for services already rendered.

Termination by Us

We reserve the right to terminate or suspend services immediately, without prior notice or refund, in the following circumstances:

You provide false, fraudulent, or misleading information in connection with our services
You engage in any of the prohibited conduct described in Section 09
You fail to make required payments after reasonable notice
Your continued use creates legal, regulatory, or reputational risk for our company
You become abusive, threatening, or harassing toward our team members
Effect of Termination: Upon termination, your right to use our services ceases immediately. Sections related to intellectual property, limitation of liability, dispute resolution, and accrued payment obligations survive termination.
Section 14
Changes to These Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will:

Update the "Last Updated" Date
The date at the top of this page will be revised to reflect the most recent update
Post a Clear Notice
A notice will appear on our website homepage for a minimum of 30 days following any material change
Notify Active Clients
Active clients will receive an email notification with a summary of key changes. Changes become effective 30 days after posting unless otherwise stated

These Terms of Service were last reviewed and updated on May 27, 2026. They constitute the complete and entire agreement between you and Above N Beyond & Associates regarding the use of our services and supersede all prior agreements, representations, and understandings.
